Corporation faces criminal charges for concealing own study in which cows died after eating its genetically modified corn Dr Eva Sirinathsinghji

Biotech giant Syngenta has been criminally charged with denying knowledge that its genetically modified (GM) Bt corn kills livestock during a civil court case that ended in 2007 [1].

Syngenta’s Bt 176 corn variety expresses an insecticidal Bt toxin (Cry1Ab) derived from the bacterium, Bacillus thuringiensis (Bt) and a gene conferring resistance to glufosinate herbicides. EU cultivation of Bt 176 was discontinued in 2007. Similar varieties however, including Bt 11 sweet corn are currently cultivated for human and animal consumption in the EU. RELATED: Genetic Genocide: Humanity’s Greatest Threat

Biotech and other emerging technology is jeopardizing the future of the human race.

In its latest effort, Fidelity Investments is aiming to drive billions of dollars of global finance capital into the emerging field of “synthetic biology”, using promotions and social media (as in its “Follow the Green Line” ad campaign) to raise interest. Fidelity is also trying to take on water shortage issues, “personalized medicine” and has partnered with the TED Talks (along with dozens of other firms) that have become a self-proclaimed authority on where technology is going. For Fidelity, it is part of an effort to bolster the firm’s image as responsible and innovative. But is it?

Just as big money has backed carbon credit schemes and green technology, Fidelity is making a push to back ‘synthetic biology,’ which it says could be the “defining technology of the 21st Century,” though admittedly it is still in the ‘experimental phase’. In essence, synthetic biology is just another buzz term for what has already become the very controversial and dangerous field of biotech & genetic engineering.

For example, scientists have shown that genetically-engineered salmon– hailed below in Fidelity’s promo video as a milestone in innovation– could wipe out the less aggressive natural salmon population within 40 generations. Fidelity also touts the use of GM bacteria to produce new malaria vaccines– part of the larger emerging field of “pharming,” or growing pharmaceutical products inside genetically-modified crops, animals, and microorganisms. For all its potential promises, GMOs have instead been linked with organ failure, infertility and reproductive problems, as well as widespread environmental impact.

Ignoring all these known risks, Fidelity’s ThinkBig webpage brags about their part in the attempt to redesign life with man-made architecture, claiming that labs could soon create 50 times the number of naturally-occurring species known to exist on the planet. And clearly that means big cash. GMO foods have been the first bounty of this technology, but the other applications are widespread, including energy, computing, organ replacements and much more. Fidelity boasts in part:

Synthetic Biologists collaborate around the world, using over 5,000 DNA sequences, called BioBricks™, now available online in an open-source database. Crowdsourcing the work means experiments that used to take years now take weeks, constantly redefining what’s possible.

Encouraging a race to create artificial life forms means less time in thinking out the potential consequences. The risks could well include endangering the survival of natural life (including humans), and would likely also prove costly for populations already vulnerable to market schemes.

Cross-species, xenotransplantation, human-animal hybrids and chimera creations all pose threats to DNA and organ receptors in ways scientists are only beginning to fully understand, while mixed genes open up new dangers of disease vulnerability between species previously not affected. This Brave New World of engineered creations, clearly, could pose instead a genetic armageddon. Alex Jones has repeatedly warned about the Trojan Horse bioweapon capabilities of much of this technology, as well as other widely used chemical compounds found throughout our food, water and environment.

Genetic Armageddon: Humanity’s Greatest Threat

Does this amount to “hacking biology” or what Alex Jones has often termed genetic vandalism? Thomas H. Murray, President of The Hastings Center gives a lecture discussing the ethical issues of creating new forms of life under the synthetic biology umbrella. This has been going on since the first recombinant DNA research began in the early 1970s, he indicates at some 13:40 minutes into the presentation. At least Murray considers the consequences, but in reality, the research field is moving forward with little concern for caution.

Apart from the risks to life itself, what finance capitol is funding is a new era of lucrative patent dominance in the realm of biology that will likely only embolden the existing oligopolies in Big Agra and Big Pharma, all while making the costs of staying alive greater to bear. “Intellectual property” issues are already plaguing traditional farmers in many parts of the world, as they clash with Monsanto’s seed monopoly. But this will also manifest in the future markets of human replacement organs grown in pigs, gene therapy, IVF and other assisted fertility, as well as many other areas. Already, claims of copyrighted human genes is occurring and impacting health care costs. Spider goats and human breast milk produced by cows are just some of the most widely publicized forms of this emerging technology front where natural sources are displaced by patented, costly and potentially dangerous GMO alternatives.

Meanwhile, the Transhumanist movement, today lead by iconic futurist Ray Kurzweil, is openly trying to re-engineer and replace the human species by merging individuals with technology– A.I., avatars, nano-tech, cloud-computing based memory banks and much more. Alex Jones’ Endgame breaks down much of this agenda.

The same science cultists who previously thought 96% of human DNA was “junk” are now playing god, assuming they can wield new life forms for human betterment. From it, the potential for financial & environmental harm, as well as predatory occupation from monopoly/oligopoly sectors is immense.

(NaturalNews) In response to mounting public backlash from the older generation, the biotechnology industry has launched a new propaganda campaign aimed at convincing children that genetically-modified (GM) crops are not only safe, but also an improvement over natural agriculture. Monsanto, Dow, Bayer, and five other major biotechnology companies and associations have collectively released the Biotechnology Basics Activity Book, a colorful guide designed to reeducate children into the false dogma of biotechnology.

The 16-page guide — which includes word scrambles, fill-in-the-blank puzzles, and matching games — contains an introductory paragraph that claims biotechnology boosts crop yields, improves environmental conditions, and leads to more nutritious food. Throughout the book, children are told that biotechnology is changing the world for the better, which is a complete contradiction to all available independent science. And yet this guide is reportedly slated for inclusion in some school curriculum’s.

“This is an activity book for young people like you about biotechnology — a really neat topic,” says the first page of the book. “Why is it such a neat topic? Because biotechnology is helping to improve the health of the Earth and the people who call it home.”

You can view the entire activity book for yourself at:
http://www.whybiotech.com

The guide was produced by a group known as the Council for Biotechnology Information (CBI), a pro-GMO coalition of the world’s largest biotechnology companies and organizations. CBI routinely ignores independent science that shows GMOs and their growing chemicals to be dangerous, and continues to purvey the lie that GMO technologies are not only safe, but that they are superior to conventional and organic growing methods.

Independent science has proven GMOs are a human, environmental health hazardGM crop systems are inherently unsustainable in every way, as they require massive amounts of chemical inputs in order to grow. They have also been shown in numerous scientific studies to cause organ damage, digestive disorders, autoimmune diseases, reproductive problems, and various other conditions.

Monsanto’s Roundup herbicide, the active ingredient of which is the weedkiller glyphosate, was recently exposed as a destroyer of testosterone and male fertility (http://www.naturalnews.com/035135_Roundup_herbicide_testosterone.html). Not only is Roundup responsible for spurring the massive “superweed” epidemic that now plagues millions of acres of American cropland, but the chemical concoction was also recently shown to trigger dozens of plant diseases (http://www.naturalnews.com/031138_Monsanto_Roundup.html).

Even when diluted by 99.8 percent, the Roundup formula is still toxic to human DNA, having been shown in a recent Archives of Toxicology study to have definitive cytotoxic and DNA-damaging properties (http://www.naturalnews.com/035050_Roundup_Monsanto_DNA.html). Environmentally, Roundup is highly persistent, and has been found in air, rainwater, and rivers all across the U.S., and particularly in the “bread belt” of the Midwest (http://www.naturalnews.com/033699_Roundup_pollution.html).

As far as GMOs themselves, there have been countless studies and reviews that have revealed serious problems with the way they are digested. A 2004 study published in Nature Biotechnology found that the genetic code of GM soy can actually alter the genetic code of gut microbiota when consumed, which can cause long-term digestive problems (http://www.naturalnews.com/028635_GMOs_bacteria.html).

None of these facts are published in the Biotechnology Basics Activity Book, of course, which makes quite the opposite claims without even a shred of proof to back them. But since young children are the book’s target audience, the biotechnology liars behind its publishing apparently hope that colorful pictures and fun word games will be enough to sway the opinion of the next generation.

Incensed by the idea that Iowans might soon be able to make their own food choices when it comes to fresh dairy products, Daniel H. Gervich, M.D., a board-certified infectious diseases and critical care medicine doctor from Des Moines, Iowa, recently declared that feeding raw milk to babies is “child endangerment.”

This outlandish claim, which was part of a recent rant he made against raw dairy published in the Des Moines Register, infers that mothers who feed their babies raw milk are abusing their children. And should anything negative happen to these children during the time in which they are drinking raw milk, their parents should apparently be held criminally responsible in Dr. Gervich’s view.

The editorial was published in response to the proposition of House Study Bill 585, a bill that would undo the State of Iowa’s highly-restrictive laws against any sale or transfer of raw milk. If passed, H.S.B. 585 would allow farmers to sell raw milk and raw dairy products directly to customers from the farm, or have it delivered, without restrictions, to customers’ homes (http://coolice.legis.state.ia.us).

Demand for raw dairy all across the country is soaring as individuals learn about the health benefits of raw milk, including how lactose intolerance is not an issue when drinking raw milk. But in many states, including in Iowa, sales of raw milk are strictly prohibited, which is why legislation like H.S.B. 585 is being introduced everywhere.

But attempts to re-legalize access to raw milk continue to be met by outmoded superstition, bad science, and blatant misinformation campaigns designed to protect the filthy dairy industry from the threat of a burgeoning raw dairy market. After all, small-scale farmers can earn a much better living selling clean, pastured raw milk to their customers independently rather than be forced to process their milk into the standardized dairy pool, where they earn a mere fraction of the profits.

“Dr. Gervich’s overused soundbite simply serves as a perfect example of the establishment attempting to wreak fear in the hearts of all parents that their children might be removed from their home if they do not agree with the prevailing medical or nutritional model consistent with medical, industry, government, (and) stakeholder made up standards,” wrote Eileen Dannemann, director of theNational Coalition of Organized Women, in response to Dr. Gervich’s editorial.

“Does the Doctor, unschooled in nutrition, plan on calling Child Protective Services for ‘child endangerment’ on those mothers who seek unadulterated, un-homogenized, un-pasteurized farm fresh milk from a sister species as a substantially equivalent substitute?”

(NaturalNews) Monsanto’s reckless disregard for public health and the agricultural stability of the planet may be even more significant than previously thought. A shocking new report reveals how Monsanto’s Roundup is actually threatening the crop-yielding potential of the entire biosphere. The report reveals that glyphosate, which was developed by Monsanto in the early 1970s and is the active ingredient in its patented herbicide Roundup, may be irreversibly devastating the microbiodiversity of the soil – compromising the health of the entire planet, as a result.

New research published in the journal Current Microbiology highlights the extent to which glyphosate is altering, and in some cases destroying, the very microorganisms upon which the health of the soil, and – amazingly – the benefits of raw and fermented foods as a whole, depend. Concerningly, certain beneficial strains of bacteria used as food-starters in cultures for raw yogurt, such as Lactobacillus cremoris, have entirely disappeared from certain geographic regions where traditionally they were found in plenty. The study reports that the death and growth inhibition of selected food microorganisms was observed in concentrations of Roundup that are lower than are recommended in agricultural practice.

This means that farmers who are increasingly using larger and larger concentrations of Roundup and similar glyphosate-based herbicide formulations to countermand the increasingly resistant super weeds GM agriculture has spawned, are not only damaging the immediate health of the soil, but subsequent yields of indispensable food-starter microorganisms, as well as the microbes that ensure the overall fertility of the soil for producing crops well into the future.

Monsanto’s Roundup assaults the planetary biosphere

Microorganisms are responsible for much more than just the health content of raw and fermented foods. The most numerous inhabitants in the web of life, microorganisms participate quite literally “at the root” of the nitrogen, phosphate, oxygen and carbon cycles, and are therefore indispensable for the health of the entire biosphere. Astoundingly, there are an estimated 6,000,000,000,000,000,000,000,000,000,000 (6 x 10 to the 30th power) bacterial cells on the planet, and these soil microrganisms represent about 50 percent of the the total biodiversity in terms of numbers of species.

As Roundup usage threatens these soil microrganisms, including fungi and the mycellium (technically the largest organism in the world), it could lead to devastating implications. Compromising the health of the mycellium, in particular, may cause serious harm to the planet. According to prominent mycologist Paul Stamets, mycellium may actually act as a ‘network’ within the biosphere, acting as the Earth’s ‘natural internet’ in which virtually all organisms may rely upon. It has been recognized throughout the ages that all life depends on the soil. Without healthy soil, the health of the entire planet is at risk.

Charles E. Kelogg was one individual who stated such in the USDA yearbook back in 1939. Kelogg said:

“Essentially, all life depends upon the soil … There can be no life without soil and no soil without life; they have evolved together.”

Franklin Delano Roosevelt also voiced similar concerns, warning:

“The nation that destroys its soil, destroys itself.”

Based on an ever-increasing body of scientific evidence showing glyphosate biodegrades slowly, sinks down through the topsoil where it accumulates in the groundwater (source for natural drinking water, e.g. aquifers, springs), and is found in nearly all air and rain samples tested in the US, it is safe to say that Monsanto’s best-selling Roundup is one of the greatest threats to human and environmental health ever created.

As the USDA continues to sit back and allow Monsanto to threaten the environmental stability of the planet, it becomes more apparent that the USDA and Monsanto are gladly willing to exchange the future of the planet and its inhabitants for short term gain. In fact, the USDA has even given Monsanto’s latest GMO crops speedier approval in order to secure the company’s profits, ignoring the numerous known harmful effects of Monsanto’s past creations, e.g. Agent Orange, Aspartame, DDT.

The known effects of Roundup

The negative effects of Monsanto’s Roundup on human health and the environment have been firmly established by numerous scientific studies and large-scale investigations, with scientists even linking the best-selling herbicide to conditions like infertility and cancer due to its genotoxic (DNA damaging) nature. Amazingly, even when diluted by 99.8 percent (450-fold lower dilutions than used in agricultural applications), Roundup still exhibits serious genotoxic characteristics and is harmful to the integrity of human DNA. Meanwhile, this carcinogenic herbicide product is used nationwide by unsuspecting homeowners and agricultural workers. According to the United States Geological Survey, 176 million lbs of glyphosate were used in the U.S. in 2007.

Outside of the public health realm, Roundup’s startling environmental havoc is perhaps an even greater cause for concern. Despite being created to fend off weeds, Roundup is actually spawning resistant superweeds across millions of hectares (one hectare is 10,000 square metres), bankrupting farmers and destroying crop land. These resistant weeds currently cover over 4.5 million hectares in the United States alone, though experts estimate the world-wide land coverage to have reached at least 120 million hectares by 2010. The onset of superweeds is being increasingly documented in Australia, Argentina, Brazil, Chile, Europe and South Africa.

The research is clear: Roundup is not only harming human health and damaging farmland, it is threatening the very biosphere itself by destroying microbial biodiversity, with the future agricultural stability of the planet, i.e. the ability to produce food through monoculturing, at serious risk of collapsing.

The laws governing the sale of drugs and food additives require substances be safe for human consumption. The artificial sweetener aspartame primarily consumed in beverages and as a popular sugar substitute has consistently been found to cause tumors and brain seizures in animal subjects. In 2005, a European Cancer Research Center, the Ramazzini Foundation, called for an urgent re-examination of aspartame in food and beverages to protect children. This call is made in the face of the US FDA stand that aspartame is safe for human consumption on the ground that “aspartame as a carcinogen is not supported by data.”

Aspartame: A brief history

As early as 1960 aspartame was determined to be a dangerous chemical and the emerging research years later only served to affirm the true nature of this artificial sweetener. Over the years, aspartame has been found to create holes in brain tissue, adversely affect the brain and nerve development in the fetus, cause cancer, migraines, headaches, seizures, convulsions and even retinal damage. With this amount of negative findings, aspartame should have been removed from the market years ago!

Ironically, aspartame was indeed removed from the market after it was already approved for limited use based on tests selected by Searle, the company who originally produced the artificial sweetener. This was after Dr. John Olney, a research psychiatrist from Washington School of Medicine, revealed that consumption of aspartic acid, a major ingredient in aspartame, produced holes in the brains of animal subjects.

After two task forces that found questionable laboratory practices as well as findings, the FDA ordered a grand jury investigation of aspartame studies, but lawyers for the government failed to initiate a legal action against Searle. Time ran out, and the grand jury investigation had to be terminated. Of interest to note was that one of the lawyers for the government, U.S. attorney William Conlon, later joined the law firm representing Searle.

Unfazed by this setback, the FDA this time recommended a Public Board Inquiry which recommended that aspartame be kept off the market until further tests could prove that it did not cause tumors. This led to a formation of another team of experts brought together to look into the Public Board of Inquiry’s conclusions. This team found itself in a deadlock over aspartame approval, causing the FDA Commissioner not to approve aspartame this time.

In April 1981, Dr. Arthur Hayes was appointed the new Commissioner for the FDA and he later approved aspartame for use in dry goods. In 1983, he also approved aspartame for use in diet drinks, conveniently leaving months later to work for Searle’s advertising agency.

Warning to aspartame consumers

We can only guess and read between the lines what kind of politics it took to get aspartame approved. After more than 8,000 complaints on Nutrasweet side effects, a list of symptoms attributed to aspartame from complaints submitted to the FDA was made public. This list included among others: hallucinations, diarrhea, seizures, depression, migraine, fatigue and insomnia. Aspartame has also been linked to tumors, cancer and infertility.

Except for a brief declaration that carefully controlled clinical studies showed aspartame is not an allergen, the FDA merely issued an advisory that products containing aspartame must include a warning to phenylketonurics, people sensitive to the compound phenylalanine. It still continues to adhere to its stand that “aspartame as a carcinogen is not supported by data.”

Aspartame was never tested on humans before its approval. Now, it is found in 6,000 products and consumed by more than 250 million people, with Americans consuming around half of the world supply. By default, we have now become the test subjects for aspartame’s safety. Unwittingly we are providing evidence to aspartame’s toxicity through the devastating effects it is slowly producing among its consumers. The list of complaints submitted to the FDA as well as from anecdotal reports does not seem to end anytime soon. If the government chooses to turn a blind eye on aspartame, let us at least choose not to be a willing conspirator and suffer the consequences of being a willing victim.

The greatest threat to human health

Your life literally depends on a clean, healthy intestinal tract. Naturally, the use of pesticides, herbicides or other toxic chemicals on our food supply should not be allowed – right? Yet, a chemical-producing corporation, like Dow – the creator of 2,4-Dichlorophenoxyacetic acid (a highly toxic pesticide/herbicide) is allowed to legally poison every person on a daily basis.

In fact, 2,4-D is the most widely used herbicide in the world, and the third most commonly used in North America. This deadly ingredient was heavily used in the production of Agent Orange – sprayed all over Vietnam during the Vietnam War. When are we going to put a stop to all this madness and save humanity!

One man helping millions of people worldwide

Harvey Diamond is an amazing validation to the healing power within each and every one of us. Harvey triumphed over a painful and debilitating muscular condition called “Peripheral Neuropathy” brought on by being exposed to Agent Orange while serving his country in Vietnam. Although he did not prevail entirely unscathed, thanks to his considerable understanding of the human body, Harvey is one of the longest known survivors of this devastating condition to still be walking around on his own without assistance.

Pesticides, like 2,4-D can be stored in your colon – where they will slowly start to poison you to death. For example, believe it or not, when you eat a non-organic apple – you are consuming around 30 different toxic pesticides that have been sprayed on that piece of fruit. The highest pesticide levels exist on strawberries, apples, carrots, celery, spinach, grapes and cucumbers. If you want to be healthy – learning about detoxification is a must!

Capturing undercover footage of extreme animal abuse at factory farms is soon to be illegal in Iowa, thanks to the passage of a new bill that squelches First Amendment protections for agricultural whistleblowers. In one of the fastest legislative rush-throughs in history, the “American Heartland” state’s House and Senate recently passed House File 589, also known as the “ag-gag” bill, which redefines undercover filming and various other whistle-blowing activities as “agricultural production facility fraud” punishable under the law.

Prior to the passage of the bill, which now sits on Republican Governor Terry Branstad’s desk for signing, exposing the horrific conditions in many of Iowa’s factory farms was a legally-protected free speech right. Once signed into law, however, H.F. 589 will make Iowa the first state in America to actively muzzle individuals from exposing the ugly truth about what takes place at chicken farms, animal processing plants, and even behemoth genetically-modified (GM) crops farms across the state.

“This flawed and misdirected legislation could set a dangerous precedent nationwide by throwing shut the doors to industrial factory farms and allowing animal abuse, environmental violations, and food contamination issues to flourish undetected, unchallenged and unaddressed,” said Nathan Runkle, executive director of the Chicago-based animal rights group Mercy for Animals(MFA), to Food Safety News. “This bill is bad for consumers, who want more, not less, transparency in production of their food.”

Without undercover investigations, the horrors of the factory food industry would never see the light of day

Undercover investigations, of course, were responsible for shutting down Hallmark and Westland, a California-based meat packing facility where extreme and highly-disturbing animal abuse was taking place on a regular basis. The company, which was eventually shut down thanks to undercover video footage captured by the Humane Society of the United States(HSUS), had been supplying tainted meat to public school lunchrooms across the U.S. (http://www.naturalnews.com/028905_school_lunch_beef.html).

You can watch a clip of that investigation at the following link. Be warned, the imagery is deeply disturbing:
http://www.youtube.com/watch?v=kaM7Hpu47FY

The sting that led to the ultimate demise of the wretched company responsible for this abuse, however, would not have been possible had an ag-gag bill similar to the one about to be passed in Iowa been in place in California at that time. In simple terms, H.F. 589 is an assault on free speech, and a clear maneuver by the filthy factory farm industry to shield its many horrors from public exposure.

You can contact Gov. Branstad’s office and urge him to reject H.F. 589 by visiting:

(NaturalNews) Rawesome Foods defendants James Steward and Sharon Palmer were ambushed in California court yesterday when they appeared for a preliminary hearing about the multiple felony charges that have been ludicrously placed against them for engaging in farm-fresh food production and distribution. In court, they were ambushed with a $1 million arrest warrant (James) and a $2 million arrest warrant (Sharon), then handcuffed and marched away by agents of the corrupt state.

This appears to all be part of California’s open war on family farming and real food. Observers present at the hearing described the ambush as something “done out of pure unadulterated intimidation” by a rogue government that has abandoned all law.

NaturalNews is holding the continuation of this story until more research and fact checking can be completed

In our original announcement of this, we stated that by Sunday evening we would roll out documented evidence that James Stewart has been targeted by rogue shadow government agents who have infiltrated California’s executive and judicial branches. Additional details are pouring in surrounding the arrest of James Stewart and Sharon Palmer, and until we can sort through all these details and fact-check the reports, we are holding our follow up story on this until sometime next week.

Something nefarious is afoot with all this, I assure you. We aim to get to the bottom of it and bring you the updated breaking news here on NaturalNews.com.

A very good overview of recent events both in Wisconsin (Vernon Hershberger) and Ventura County (James Stewart and Sharon Palmer) has been posted by The Complete Patient, a very informative website covering raw milk. You can read it here:
http://www.thecompletepatient.com/journal/2012/3/3/hershberger-lives-…

One thought that immediately comes to mind in the finance-related charges against Sharon Palmer is that first the state of California made it impossible for Sharon to repay her loans on the farm by fining her and terrorizing her business beginning in 2008. And then, we she was unable to repay those loans, they charged her with multiple counts of felony financial fraud for failing to repay the loans. Or at least that’s the simplified version of what appears to be happening. It’s quite complex and there are many players, including at least one person in Wisconsin who is an enemy of James Stewart. So there is definitely some in-fighting going on across this industry.

By the way, yesterday I released a new InfoGraphic describing the differences between raw (fresh) milk and dead pasteurized milk. It’s very enlightening and well worth sharing. You can view it here:

OSGATA
February 28, 2012

On February 24, Judge Naomi Buchwald handed down her ruling on a motion to dismiss in the case of Organic Seed Growers and Trade Assn et al v. Monsanto after hearing oral argument on January 31st in Federal District Court in Manhattan. Her ruling to dismiss the case brought against Monsanto on behalf of organic farmers, seed growers and agricultural organizations representing farmers and citizens was met with great disappointment by the plaintiffs.

Plaintiff lead attorney Daniel Ravicher said, “While I have great respect for Judge Buchwald, her decision to deny farmers the right to seek legal protection from one of the world’s foremost patent bullies is gravely disappointing. Her belief that farmers are acting unreasonable when they stop growing certain crops to avoid being sued by Monsanto for patent infringement should their crops become contaminated maligns the intelligence and integrity of those farmers. Her failure to address the purpose of the Declaratory Judgment Act and her characterization of binding Supreme Court precedent that supports the farmers’ standing as ‘wholly inapposite’ constitute legal error.  In sum, her opinion is flawed on both the facts and the law. Thankfully, the plaintiffs have the right to appeal to the Court of Appeals, which will review the matter without deference to her findings.”

Monsanto’s history of aggressive investigations and lawsuits brought against farmers in America have been a source of concern for organic and non-GMO farmers since Monsanto’s first lawsuit brought against a farmer in the mid-90′s. Since then, 144 farmers have had lawsuits brought against them by Monsanto for alleged violations of  their patented seed technology.  Monsanto has brought charges against more than 700 additional farmers who have settled out-of-court rather than face Monsanto’s belligerent litigious actions. Many of these farmers claim to not have had the intention to grow or save seeds that contain Monsanto’s patented genes. Seed drift and pollen drift from genetically engineered crops often contaminate neighboring fields. If Monsanto’s seed technology is found on a farmer’s land without contract they can be found liable for patent infringement.

“Family farmers need the protection of the court,” said Maine organic seed farmer Jim Gerritsen, President of lead plaintiff OSGATA.  ”We reject as naïve and undefendable the judge’s assertion that Monsanto’s vague public relations ‘commitment’ should be ‘a source of comfort’ to plaintiffs. The truth is we are under threat and we do not believe Monsanto. The truth is that American farmers and the American people do not believe Monsanto. Family farmers deserve our day in court and this flawed ruling will not deter us from continuing to seek justice.”

The plaintiffs brought this suit against Monsanto to seek judicial protection from such lawsuits and challenge the validity of Monsanto’s patents on seeds.

“As a citizen and property owner, I find the Order by the Federal Court to be obsequious to Monsanto,” said plaintiff organic farmer Bryce Stephens of Kansas.  ”The careless, inattentive, thoughtless and negligent advertisement Monsanto has published on their website to not exercise its patent rights for inadvertent trace contamination belies the fact that their policy is in reality a presumptuous admission of contamination by their vaunted product on my property, plants, seeds and animals.”

“Seeds are the memory of life,” said Isaura Anduluz of plaintiff Cuatro Puertas and the Arid Crop Seed Cache in New Mexico.  ”If planted and saved annually, cross pollination ensures the seeds continue to adapt. In the Southwest, selection over many, many generations has resulted in native drought tolerant corn.  Now that a patented drought tolerant corn has been released how do we protect our seeds from contamination and our right to farm?”
